Tzvia Sariel is being released today after her false arrest by the oppressive judicial system, which degrades, even according to its own values, human dignity and plots against its freedom. With uncompromising, childish sadism, Shai Nitzan, an oppressor of Israel, second to the legal advisor to the government, tried to delay her release at the last second.

Together with this, we should not forget Itai Zer, a resident of Chavat Gilad in Samaria, an additional sacrifice for the system which specializes in blood libels, is still sitting in jail when he has not committed a crime. Additional Jewish prisoners who were forced in to desperate acts by the same libelous, degrading, and oppressive system, serve long prison terms. On the other hand, the supposed advocates of justice, the knights of the rule of enlightened law desire to advance the wholesale release of Arab terrorists with blood on their hands in order to push further desperate Jews against the wall.

Tzvia Sariel is fought a war, with none more justified, for the sake of victory over evil and the uprooting of the foreign law which has prevailed over the nation of Israel as it wages a desperate war against the weak, and singles this foreign law out as the source for all the illnesses.

If one sees that troubles are coming upon Israel, go and check the judges of Israel.

Tzvia Sariel again announced that she is willing to be judged only in front of a Torah court, and she does not recognize the authority of the secular court system. Thus she points out the real purpose of the national struggle of the nation of Israel, whose basis is the only natural law which obligates Jews, the laws of Torah and no others.

Thus Tzvia Sariel provides an example for her nation like Yehudit, daughter of Matityahu, who recognized the truth before the rest of her generation.

It should be noted that the irrational oppression and hatred of those who hate the Torah and its observers (among which Shai Nitzan stands at the head, acting like the apostates appearing constantly throughout the history of decrees against the nation of Israel, who have always stood with the greatest haters of Israel) explains the motives for the evil.

From the beginning of her struggle, the Court for Matters of Nation and State, headed by Rabbi Yisrael Ariel, has backed Tzvia Sariel and even instructed the court system to release her from her arbitrary incarceration before, on the 7th of Adar 5758. Rare judges who were not damaged in the system followed the instructions of the Court and brought Tzvia Sariel before the Court for Matters of Nation and State, which decided for her release. Indeed then she was released after 3 days due to doubt, in which Judge Nava Bechor revealed the blood libel against the Jewish girls.

We call to the entire community of rabbis from all streams to declare their position in this affair, like in the Har Bracha Hesder Yeshiva affair, and to strengthen the force of Torah law in Israel by setting up a system of courts in every city and town, in order to advance the vision of Justice Minister Ne’eman, the vision of Torah, which sets that the law of Torah will be the law of the land of Israel. “Judges and officers you shall set up in all of your gates… so that you should live and inherit the land.” There is hour more appropriate than now for this matter.

''Members of the ruling powers in the Palestinian authority have announced that they are considering declaring an independent, sovereign Palestinian State in an area that includes Judea and Samaria. <big>'''Declaration of the Jewish Nation's sovereignty over Judea and Samaria Application of the principles of Torah'''</big>

We hereby declare in this, in front of all the nations, the sovereignty of the Jewish Nation, and mainly of the Jewish residents actively living in the regions of Judea and Samaria, more than 120 communities amounting to more than 350,000 Jews, as sovereign regions of the Jewish State, and this is apart from the Jewish residents in Jerusalem neighborhoods and in the Golan, counting for about 250,000 additional Jews, may they increase. Sixty myriads of Jews, like the number of Jews in the Land of Israel at the time of the Declaration of the State of Israel in 5708 (1948), may it prosper and flourish.

The sovereignty declared here is reserved for the State of Israel, until it is established as the state of the Nation of G-d according to the Torah of G-d, within the regions of the Land of Israel’s biblical borders.

The Torah is the foundation of the constitution of the nation of Israel as it was given at Sinai, which existed since before creation; it is the testimony of G-d’s will, His actions, and His laws.

Therefore, the applicable and obligatory law in Judea and Samaria since earliest times and eternally, like in all of the Land of Israel is the law of Torah, even if foreign entities, or Jewish entities which do not recognize this law, and act according to foreign laws recognize this.

Application of the law does not require the agreement of any political or governmental authority.

The existing laws of the State of Israel in Judea and Samaria and in the Golan may remain in force as long as they do not contradict the laws of Torah.

In order to implement the laws of Torah in action, we call to all of the communities of Judea and Samaria and the Golan to set up Courts acting in accordance with Torah law. Each Court will comprise not less than three people, who keep Torah and fear G-d, despite profiteering, of public renown, and also are representatives of the public, having been elected in elections held for this purpose. Recommendations on the matter of management of the election process for the courts will appear in an appendix.

The government of Israel threatens that if the Arabs and the United Nations were to declare or recognize a Palestinian State, that the State of Israel may take actions steps towards annexing settlement blocks.

Such a declaration is an admission, in a roundabout manner, that Israel has the eternal residual right to impose and to implement its sovereignty in all of the Land of Israel, and it is only due to slavery to the process called the “peace process”, and the misunderstanding of the State of Israel as being part of the family of nations, that Israel does not implement what is known to all, even in the core writings of Islam and Christianity, that the Land of Israel is the inheritance of the Nation of G-d, the Nation of Israel.

The cowardly policies of Israeli governments, at least since 5727 (1967), brought upon the Jewish Nation, and upon its sovereignty in the Land of Israel, the disaster, which continues to become more explicit after the Goldstone Report, whose essence is the founding of a foreign Arab state in regions of the Land of Israel which will be recognized by the nations of the world, organized in the United Nation. The Israeli governments, in their denial of the sovereign rights of the Jewish Nation on the Land of Israel, in opposition to the set covenants in the Torah between G-d and the forefathers of the nation, and the words of the prophets, and including international law decisions in the years 1920 and 1922, cause, as stated, disaster for the nation, in whose and for whose sake they pretend to speak.

Israeli governments have denied, due to political pressures, the sovereignty of the Nation of Israel on strips of land in the heart of its homeland, including Jerusalem, in that they did not actualize the Basic Law of Jerusalem. They preferred to refer to them as "occupied territories". This denial was made worse by the High Court, in their infamous decision that these strips of land are occupied territories are in a perpetual state of war until their evacuation. This perversion was used as justification for ethnic cleansing of the Gaza Strip by means of the expulsion and banishment of its Jewish residents, and destroying their means of livelihood. This despicable act is meant to be used as a president to permit the expulsion and banishment of Jews, and their ethnic cleansing from regions of their land, the Holy Land. These regions of land were liberated, with the help of the Creator, in war, which the Arabs initiated in the year 5727 (1967), and also in the defensive War of Independence in 5708 (1948).

This behavior presents the Jewish Nation as burglars, and its land, state, and government as war criminals.
The High Court, the Attorney General, and the haters of Israel within, aroused the recognition and courage of, what is known as the Palestinian entity, to declare statehood. Therefore the High Court, the Attorney General, and all those associated with them carry the consequences for the results and damages in life and property and removing Israel from its land, and will give accounting if and when the hand of Israel will become strengthened, with the grace of G-d.

We declare that any foreign political entity, in the regions of the Land of Israel, which is not Jewish is an illegal and temporary entity, and is destined to be uprooted.

Activities of the Israel Defense Forces against Jewish communities, their uprooting, and the exile of Jews from them, in part or whole; these actions are expressly illegal. It is easy to show that in the circumstances which have been created, according to which swaths of the Land, including the “settlement” of Gilo, are under dispute and threat of Arab and international capture.

Therefore, whomever acts towards the destruction of Jewish communities acts for the sake of foreign interests, and undermines the existence of the nation of Israel in its land, and acts against the laws of Torah, and will in the future be punished for this by the hands of Heaven.
Destruction of Jewish communities is the actualization of the call of the American government not to build in the neighborhood of Gilo. The destiny for the settlement Negohot is like that of the neighborhood of Gilo, and the destiny of the neighborhood of Rechavia and every other place in Jerusalem. Every person who is employed in the evacuation and exile and destruction is excommunicated by Heaven and excommunicated by man, and will not be designated in the community.

We are convinced that the heads of yeshivas will not be frightened from threats, and will find ways to sustain their institutions and to strengthen the trust of the yeshiva students in their chosen path, the way of Torah.

We pray that the eyes of the government, like the eyes of all people, will open up to see the difficult situation in which the nation of Israel and its state is in, and therefore it will cease any process of evacuation and plans of expulsion, and instead of this will work to spread out the flocks on the mountains of Israel, and worry for all that it is lacking.

The Jewish Nation, under its present regime, sits on the fence. It cannot, in its current state, receive any legitimacy from the nations of the world, but only earn their disdain, for it doesn’t act according to divine laws, promises and covenants, which cause, G-d forbid, the punishments and curses written in the Torah.

The Iran affair is the result of the removal of the divine image from the shepherds of Israel for many years, who withheld the Nation of Israel from recognition, study, and education that the name of G-d is called upon it, and therefore the nations of the world fear it.

As long Nation of Israel does not act according to its ways, from amidst a divine spiritual identity, in holiness and purity, expressing the national spirit, the State of Israel will not be able to overcome its enemies, and G-d forbid, the curses will be fulfilled.

Deuteronomy 28 (43) The stranger in your midst will rise up high and higher, and you will go down lower and lower… (47) Because you have not served Hashem your G-d in happiness and goodness of heart from abundance… (52) And he will trouble you in all of your gates until your fortified high walls, that you trust, come down in all your land, and he will trouble you in all the gates in all the land that Hashem your G-d gave you.

We call to all Jews and all people, and all the nations and countries of the world to repent, to avoid theft, bloodshed, and sexual sins, and to accept the yoke of Torah and commandments, every nation according to what is proper for him, and to help the Nation of Israel to cherish the dust of its land, and to erect its Temple on the Temple Mount and to call together to the G-d of Israel, G-d of the world, and to announce the abandonment of perverted ideas to establish a foreign state in the Land of Israel.

Below is a partial list of the legal rulings and opinions of the court. They are collected from the legal proceedings of the nascent Sanhedrin and its subcourts. Most of them were originally issued in Hebrew, with a minority in English. A translation to English is provided when available. It is possible to see a list of urgent and important public [[Urgent and important announcements|announcements here]].

The [[Sanhedrin Initiative]] consists of the nascent Sanhedrin, four subcourts and more than a dozen committees.<ref>See [[Organization of the Nascent Sanhedrin|Organization of the Sanhedrin]]</ref>

The courts and committees function within the charters they have been given by the "Special Court for the Executive Oversight of the Sanhedrin", but they may functional independently. Views expressed by subcourts and committees of the Sanhedrin Initiative, in general, have not be reviewed by the nascent Sanhedrin and as such they carry only the authority that a regular Jewish court of law or committee would hold.

Besides their normal function, these courts and committees are to develop "expert legal opinions" and "legal briefs" that may be used at a future date when a full sanhedrin may decide on these issues. Until that time, their views do not necessarily reflect the binding decision of a Sanhedrin, or even the views of all the members of the Sanhedrin Initiative.

Article of Dr. Michael Bronstein in the framework of the Sanhedrin’s Security Commission.

1. There is no system that doesn’t make errors. It appears that there are only two systems that claim to not make mistakes: The Judicial System and the religious establishment. It should be understand that these claims necessarily destroy them from within.

2. As a model, it is possible to classify the systems in the following way:

A. Systems which fix themselves in a continual way by internal initiative.
 B. Systems which receive outside criticism and are “happy” to fix the faults that they reveal.
 C. Systems which do that against their will.
 D. Systems which obstruct the reform, including denying the criticisms’ conclusions.
 E. Systems which prevent criticism with hatred (this type of system is called “totalitarian”)
 F. Systems which accept criticism, but don’t do anything with it (such systems are, from a philosophical standpoint, classified as “post-modernist”). Such systems will claim “we are fixing ourselves”, thus it is impossible to disprove this claim at its base, but it should be known that it is likely to be complete falsehood.

3. The IDF, at least starting from the Yom Kippur War “fixes itself”, and thus has deteriroated from war to war. This is the main item of data which will focus it in the systems scale. The governmental system in Israel, which was built on a Ben Gurion-ist basis, was never in level D or lower. Lately, it has enthusiastically adopted the post-modernist and neo-Marxist philosophy, indeed what characterizes a focus on level F.

4. The Greenbaum Commission (1948) was the first to reveal administrative faults of the war (the War of Independence) by the political echelon; Ben-Gurion blocked the findings by way of threat of his own resignation. The Agranat Commission came on the heels of the Yom Kippur War; it revealed some of the faults; it could have served as an impetus to necessary and positive change, but it was blocked by the aggressive action of the IDF elite and the political echelon. The Winograd Commission comes on the heels of the “Second Lebanon War” (when there was no official “First”); one should not expect that it reveal all the truth; that is not its real purpose. Its real purpose is to silence the critical failures, Archimedean points, and thus to open a path to change in the security culture in Israel. Under the umbrella of the word “culture”, all the layers of the nation fall, each in its possible strength.

5. The Commission indeed found a few Archimedean points.

A. Magical abstention from conquering territory.
 B. Continuous decline at least since the year 2000.
 C. The emptiness of the “Desire for peace” without the backing of force and ability have been proven, in spite of the popular mantra of “limits to strength”. But the Commission did not arrive at the most important point:
 D. The public’s ignorance in matters of army and war. “The public” here is referring to the entire nation, and all the groups of its leaders present at the historic moment in question, with the personal participation in combat units, and even in battle, makes no difference. In Israel of 2008, there is no military insight, nor is there interest in military matters, including the senior leadership of the army; in opposition to this, there are claims to understanding on an ideological basis, cultural fashion, or “complete lack of error”, when referring to the two wars mentioned above.

6. The IDF claimed and claims that “we have no other army”, and when it is evident that “dangers of outside exposure have their costs”. This is an invalid claim: Exactly due to the fact that we have no other army, it is in need of external criticism, unless it will also claim that it is a level A system (of above), which is obviously not true, nor was it temporarily true, and it is impossible to rely on this ideal situation for the long term (see the declaration of decline from the year 2008).

7. The IDF and the government claimed and continue to claim together and separately that “we are already fixing things”. The reports from the field and from within contradict this claim, and therefore necessarily place these systems at least between levels E and F from above. A mystery envelope, also called “classified”, does not cover up the main thing uncovered: Key people in the systems were not trained for their positions, and were never interested in the military field to begin with. If we rely on this, that those who do not understand the matter will be able to “fix it”, we will be “relying on a miracle”. It is logical to think that they are also not interested in the base reforms, except if they would prove the opposite by publicly acknowledging the errors they made, and give an in depth analysis to their causes, firstly the cultural causes. It should be recalled that we’re talking about Prime Ministers, Defense Ministers, Chiefs of Staff and their deputies, at least from the year 2000 onward, and almost with certainty it is possible to say at least from 1990.

8. The IDF has claimed and continues to claim that “the Commission puts the responsibility on the military echelon and provides cover for the political echelon”; as support for this, the report of the Agranat Commission is brought from the year 1974. It should be noted: this is a myth which the IDF constructed, and, to our regret, succeeding in entrenching in the public consciousness. It was the defense argument then and they are building a similar defense now. With complete responsibility, the following proclamation should be made: The Agranat Commission indeed covered up for the political echelon, but it also did the same for the military echelon, to the point where a virtual reality was built in certain parts of the report. The difference was that the faults of the IDF were much greater than those of the government, which were also great, such that it was no longer possible to hide them or pass them off for “self repair”. Indeed, as we said, the IDF succeeded in blocking the internal process of change (primarily in the field of training of senior officers), and outward change as well (in entrenching the military consciousness in all levels of the public). In particular, it was in the IDF elite’s interest that the political echelon remain “ignorant”, in order to ease paving the way of senior officers to the political elite. Starting with Yitzchak Rabin, through Yigal Yadin, Rechavim Ze’evi (Gandi), and Ehud Barak, and including Ariel Sharon, the officer-politicians have proven that they do not understand the problems that the IDF has and they are incapable of fixing them.

9. As was mentioned, it is not to be expected that the Commission’s conclusions would reveal all of the problems, but just that it would give the first push on a long and painful, yet necessary, process. It should be accepted that at a first stage that base solutions would not be found, but rather “band-aids”, and even that some problems would remain without any solution. In the long term, a new generation of leadership must be raised, whose key word would be professionalism in its entire meaning, and not its minimalistic meaning. No ideology, be it religious, nationalistic, or humanistic, can replace the professional ability, nor can it determine that ability.

10. Perhaps the Sanhedrin cannot lead the needed process, but it certainly can contribute to it. The situation at present is one akin to a situation where “there are no men”, and the Sanhedrin would be sinning to the G-d of Israel if it did not stand to the requirement of “attempt to be a man”.

We hereby declare in this, in front of all the nations, the sovereignty of the Jewish Nation, and mainly of the Jewish residents actively living in the regions of Judea and Samaria, more than 120 communities amounting to more than 350,000 Jews, as sovereign regions of the Jewish State, and this is apart from the Jewish residents in Jerusalem neighborhoods and in the Golan, counting for about 250,000 additional Jews, may they increase. Sixty myriads of Jews, like the number of Jews in the Land of Israel at the time of the Declaration of the State of Israel in 5708 (1948), may it prosper and flourish.

The sovereignty declared here is reserved for the State of Israel, until it is established as the state of the Nation of G-d according to the Torah of G-d, within the regions of the Land of Israel’s biblical borders.

The Torah is the foundation of the constitution of the nation of Israel as it was given at Sinai, which existed since before creation; it is the testimony of G-d’s will, His actions, and His laws.

Therefore, the applicable and obligatory law in Judea and Samaria since earliest times and eternally, like in all of the Land of Israel is the law of Torah, even if foreign entities, or Jewish entities which do not recognize this law, and act according to foreign laws recognize this.

Application of the law does not require the agreement of any political or governmental authority.

The existing laws of the State of Israel in Judea and Samaria and in the Golan may remain in force as long as they do not contradict the laws of Torah.

In order to implement the laws of Torah in action, we call to all of the communities of Judea and Samaria and the Golan to set up Courts acting in accordance with Torah law. Each Court will comprise not less than three people, who keep Torah and fear G-d, despite profiteering, of public reknown, and also are representatives of the public, having been elected in electrions held for this purpose. Recommendations on the matter of management of the election process for the courts will appear in an appendix.

The government of Israel threatens that if the Arabs and the United Nations were to declare or recognize a Palestinian State, that the State of Israel may take actions steps towards annexing settlement blocks.

Such a declaration is an admission, in a roundabout manner, that Israel has the eternal residual right to impose and to implement its sovereignty in all of the Land of Israel, and it is only due to slavery to the process called the “peace process”, and the misunderstanding of the State of Israel as being part of the family of nations, that Israel does not implement what is known to all, even in the core writings of Islam and Christianity, that the Land of Israel is the inheritance of the Nation of G-d, the Nation of Israel.

The cowardly policies of Israeli governments, at least since 5727 (1967), brought upon the Jewish Nation, and upon its sovereignty in the Land of Israel, the disaster, which continues to become more explicit after the Goldstone Report, whose essence is the founding of a foreign Arab state in regions of the Land of Israel which will be recognized by the nations of the world, organized in the United Nation. The Israeli governments, in their denial of the sovereign rights of the Jewish Nation on the Land of Israel, in opposition to the set covenants in the Torah between G-d and the forefathers of the nation, and the words of the prophets, and including international law decisions in the years 1920 and 1922, cause, as stated, disaster for the nation, in whose and for whose sake they pretend to speak.

Israeli governments have denied, due to political pressures, the sovereignty of the Nation of Israel on strips of land in the heart of its homeland, including Jerusalem, in that they did not actualize the Basic Law of Jerusalem. They preferred to refer to them as "occupied territories". This denial was made worse by the High Court, in their infamous decision that these strips of land are occupied territories are in a perpetual state of war until their evacuation. This perversion was used as justification for ethnic cleansing of the Gaza Strip by means of the expulsion and banishment of its Jewish residents, and destroying their means of livelihood. This despicable act is meant to be used as a president to permit the expulsion and banishment of Jews, and their ethnic cleansing from regions of their land, the Holy Land. These regions of land were liberated, with the help of the Creator, in war, which the Arabs initiated in the year 5727 (1967), and also in the defensive War of Independence in 5708 (1948).

This behavior presents the Jewish Nation as burglars, and its land, state, and government as war criminals.
The High Court, the Attorney General, and the haters of Israel within, aroused the recognition and courage of, what is known as the Palestinian entity, to declare statehood. Therefore the High Court, the Attorney General, and all those associated with them carry the consequences for the results and damages in life and property and removing Israel from its land, and will give accounting if and when the hand of Israel will become strengthened, with the grace of G-d.

We declare that any foreign political entity, in the regions of the Land of Israel, which is not Jewish is an illegal and temporary entity, and is destined to be uprooted.

Activities of the Israel Defense Forces against Jewish communities, their uprooting, and the exile of Jews from them, in part or whole; these actions are expressly illegal. It is easy to show that in the circumstances which have been created, according to which swaths of the Land, including the “settlement” of Gilo, are under dispute and threat of Arab and international capture.

Therefore, whomever acts towards the destruction of Jewish communities acts for the sake of foreign interests, and undermines the existence of the nation of Israel in its land, and acts against the laws of Torah, and will in the future be punished for this by the hands of Heaven.
Destruction of Jewish communities is the actualization of the call of the American government not to build in the neighborhood of Gilo. The destiny for the settlement Negohot is like that of the neighborhood of Gilo, and the destiny of the neighborhood of Rechavia and every other place in Jerusalem. Every person who is employed in the evacuation and exile and destruction is excommunicated by Heaven and excommunicated by man, and will not be designated in the community.

We are convinced that the heads of yeshivas will not be frightened from threats, and will find ways to sustain their institutions and to strengthen the trust of the yeshiva students in their chosen path, the way of Torah.

We pray that the eyes of the government, like the eyes of all people, will open up to see the difficult situation in which the nation of Israel and its state is in, and therefore it will cease any process of evacuation and plans of expulsion, and instead of this will work to spread out the flocks on the mountains of Israel, and worry for all that it is lacking.

The Jewish Nation, under its present regime, sits on the fence. It cannot, in its current state, receive any legitimacy from the nations of the world, but only earn their disdain, for it doesn’t act according to divine laws, promises and covenants, which cause, G-d forbid, the punishments and curses written in the Torah.

The Iran affair is the result of the removal of the divine image from the shepherds of Israel for many years, who withheld the Nation of Israel from recognition, study, and education that the name of G-d is called upon it, and therefore the nations of the world fear it.

As long Nation of Israel does not act according to its ways, from amidst a divine spiritual identity, in holiness and purity, expressing the national spirit, the State of Israel will not be able to overcome its enemies, and G-d forbid, the curses will be fulfilled.

Deuteronomy 28 (43) The stranger in your midst will rise up high and higher, and you will go down lower and lower… (47) Because you have not served Hashem your G-d in happiness and goodness of heart from abundance… (52) And he will trouble you in all of your gates until your fortified high walls, that you trust, come down in all your land, and he will trouble you in all the gates in all the land that Hashem your G-d gave you.

We call to all Jews and all people, and all the nations and countries of the world to repent, to avoid theft, bloodshed, and sexual sins, and to accept the yoke of Torah and commandments, every nation according to what is proper for him, and to help the Nation of Israel to cherish the dust of its land, and to erect its Temple on the Temple Mount and to call together to the G-d of Israel, G-d of the world, and to announce the abandonment of perverted ideas to establish a foreign state in the Land of Israel.
